In no event shall ResumeMatchMaker.com or advertisers, be liable for any damages whatsoever (including, without limitation, incidental and consequential damages, lost profits, or damages resulting from lost data, lost employment opportunity, or business interruption) resulting from the use or access to, or the inability to use or access, the ResumeMatchMaker.com web site and the content and/or any document, whether based on warranty, contract, tort, or any other legal theory, and whether or not ResumeMatchMaker.com is advised of the possibility of such damages.

Guarantee: This Guaranty (the 30 day Free Distribution) is a guarantee which shall expire or will be null and void once ResumeMatchMaker.com has met any or part of conditions outlined in section (G1) and relates to any obligations including those which arise under successive transactions.  

Guaranty of Obligations:  Guarantor unconditionally, absolutely and irrevocably guarantees and promises to pay to Buyer, provided Seller failed to meet all conditions outlined in section (G1) within 60 days from the time of purchase of any service, in lawful money of the United States.  Payment to Buyer of sums equal to original charges or cost of service. 

Waiver of Defenses:  Buyer hereby waives any right to assert against Seller as a defense, counterclaim, setoff on cross claim, any defense (legal or equitable), setoff, counterclaim and claim which Buyer may now or at any time hereafter have against Seller and any other party liable to Seller in any way or manner 

Waiver of Jury Trial.  Buyer waives any right to a jury trial in any action hereunder or arising out of Buyers transactions with Seller.

Waiver of Rights of Subrogation.  The Buyer shall have no right of subrogation, reimbursement, exoneration, contribution or any other rights that would result in the Seller being deemed a creditor under the United States Bankruptcy Code or any other law or for any other purpose and the Buyer hereby irrevocably waives all such rights, the right to assert any such rights and any right to enforce any remedy which Buyer may now or hereafter have against Seller.

Attorneys Fees.  Buyer agrees to pay all attorneys fees and all other costs and out-of-pocket expenses which may be incurred by Seller in the enforcement of this Guaranty.

G1): 

• ResumeMatchMaker.com fails to email Buyers resume and/or cover letter within 5 business days from the time the order was placed
• Buyer receives no response from recruiters, direct hiring companies and/or temporary agencies within 30 days
• The Buyer receives no confirmations from the subscribed recruiters, direct hiring companies and/or temporary agencies

ResumeMatchMaker.com does not guarantee that documents posted by users or the use of this service will result in candidates being hired or positions being filled, and is not responsible for any employment decisions, for whatever reason made, which are made by any user.

ResumeMatchMaker.com does not warrant that the web site will operate error-free or that this web site and its servers are free of computer viruses or other harmful mechanisms. If your use of the web site or the material results in the need for servicing or replacing equipment or data, ResumeMatchMaker.com is not responsible for those costs. You assume all responsibility and risk for your use of this site and the internet generally. The ResumeMatchMaker.com web site and its content are provided on an 'as is' basis without any warranties of any kind, express or implied. ResumeMatchMaker.com, to the fullest extent permitted by law, disclaims all warranties, including the warranties of merchantability, title, non-infringement of third parties rights, and fitness for particular purpose. ResumeMatchMaker.com makes no warranties about the accuracy, reliability, completeness, or timeliness of the material, services, software, text, graphics, and links.

YOU UNDERSTAND THAT WE MAY AT ANY TIME (DIRECTLY OR INDIRECTLY) SOLICIT CUSTOMER REFERRALS ON TERMS THAT MAY DIFFER FROM THOSE CONTAINED IN THIS AGREEMENT OR OPERATE WEB SITES THAT ARE SIMILAR TO OR COMPETE WITH YOUR WEB SITE. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF PARTICIPATING IN THE PROGRAM AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT.

7) General: ResumeMatchMaker.com is based in Louisville, Kentucky. The company makes no claims that the content is appropriate or may be downloaded outside of the united states.

Access to the content may not be legal by certain persons or in certain countries. If you access ResumeMatchMaker.com from outside of the united states, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. These terms and conditions are governed by the internal substantive laws of the state of Kentucky, without respect to its conflict of laws principles. Jurisdiction for any claims arising under this agreement shall lie exclusively with the state or federal courts in Jefferson county Louisville, Kentucky. If any provision of this agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this agreement, which shall remain in full force and effect. No waiver of any term of this agreement shall be deemed a further or continuing waiver of such term or any other term. Except as expressly provided in a particular "legal notice," or software license or material on particular web pages, this agreement constitutes the entire agreement between you and ResumeMatchMaker.com with respect to the use of the site. You understand and agree that, due to the nature of these terms and conditions, in addition to money damages, ResumeMatchMaker.com will be entitled to equitable relief upon a breach of these terms and conditions by you.
